JOB DESCRIPTION This role is to effectively manage the relationships, interaction and transactions between the stakeholders where various contractual agreements exist between organs of State and Private suppliers of Energy in accordance with the terms of such agreements. This is a 3 year contract.
KEY RESPONSIBILITIES To effectively, monitor and ensure the execution of each party’s obligations in terms of the master agreement, including but not exclusively to: 1. Implement and apply the contract management strategy aligned and integrated with the overall IPP Office Strategy. Ensure the timely execution of obligations 2. Apply the principles of law of Contract and Administrative Law as well as principles of public procurement in contract management. Ensure the rights of both parties are exercised appropriately 3. Ensure successful contract management. Monitor reporting on construction milestones for relevant projects to identify risks Ensure reporting mechanisms are in place to ensure that all aspects various contracts are measurable 4. Ensure effective and timely compliance monitoring. Manage compliance by IPP’s on all aspects of the Contracts Ensure Monitoring and execution of IPP and Eskom’s obligations under the Power Purchase Agreements and Implementation Agreements Ensure management and monitoring of regulatory, legislative and Eskom Governance compliance 5. Build and Maintain strategic partnerships. Identify, create and leverage relationships with key external and internal stakeholders Managing and maintaining relationships between all parties 6. People enablement Create the conditions that are conducive to team work and contribute to the team building (e.g. team spirit).

REQUIREMENTS FOR THIS JOB |
EXPERTISE & TECHNICAL COMPETENCIES 1. A Tertiary Legal Degree is required with law of contract and administrative law and at least 1 year experience in a complex infrastructure procurement contracts environment. 2. At least 3 to 5 years’ experience at junior or middle management level. 3. Knowledge and understanding of the Energy Sector public sector bodies and relevant standardisation bodies 4. Advanced knowledge of Administrative Law. 5. Advanced knowledge and understanding of legislation, regulations and practices related to public sector procurement, such as PFMA, PPPFA. 6. Knowledge and understanding of legislation and the Policy Framework in the Energy Sector 7. Knowledge and understanding of application of applicable law 8. Knowledge and understanding of Monitoring and Compliance practices and processes 9. In depth knowledge of interpretation of contracts 10. Application of law and policy to facts 11.
