JOB ADVERT SUMMARY
The Land and Agricultural Development Bank of South Africa (Land Bank) is South Africa’s only specialist agricultural bank established in 1912, the bank’s sole objective is to serve South African commercial and emerging farmers and bring specially designed financial services within their reach. These services enable farmers to finance land, equipment, improve assets and obtain production credit. As change has swept across the sector in South Africa the socio-economic makeup of agriculture has altered, bringing new entrants from historically disadvantaged backgrounds on to the land, these new farmers, facing the challenges of establishing sustainable agri-businesses across the agricultural value chain, Land Bank has been a commercial lifeline offering appropriately designed financial products that facilitate personal and commercial viability in a sector that is vital to the sustainability of South Africa and its people.

MAIN PURPOSE OF THE JOB
1. To design, implement and manage an end-to-end legal recoveries capability that is recognised as a valuable and strategic function of the Land Bank.
2. The function should maximise cost-effective recoveries, supporting retail and business and corporate banking strategy. Maintains acceptable Non-Performing Loans (NPLs) percentage in relation to the loan book.

KEY PERFORMANCE AREAS
Legal and Solvency Strategy development and overseeing the legal recovery process including insolvency and debt collection
1. In alignment to the corporate plan develops, implements and maintains the legal recovery and insolvency strategies to maximise recoveries and minimise NPLS’s
2. Manage various functions within Legal Recoveries in order to maximise cost effective recoveries.
3. Determine what right-off is appropriate and is in the best interest of the Land Bank.
4. Develop, implement and enforce right-off processes and related policies.
5. Manage and monitor the matters that are referred to attorneys and debt collectors as well as for liquidation
6. Manage the insolvency process including validation of claims and liquidation of them and distribution accounts
7. Monitor and evaluate the performance of the attorneys.
8. Identify effective risk controls and put proper risk control assessment in place and reviewed annually

Management of stakeholder relations
1. Oversee and manage the flow of relevant information to best inform stakeholders as to the status of the portfolio or individual clients within the portfolio
2. Where appropriate generate feedback to stakeholders to improve future risk decisions and ensure past mistakes are prevented
3. Drives stakeholder alignment and satisfaction utilising sound stakeholder management techniques
4. Maintain relationships with external service providers (attorneys; debt collectors, etc.) and handle their queries timeously.
5. Maintain relationships with clients.
6. Maintain relationships with the relevant government departments (DRDLR, DAAF, etc.)
7. Maintains good communication and reporting lines with branches.

Reporting and information systems
1. Manco reporting – detailed reports on amounts recovered and NPLS as well as cost effectiveness
2. Credit Risk operations (CROM) reporting – identifying and highlighting from a recoveries and NPL perspective
3. Exco reporting – high level reporting on overall recoveries and NPLs as well as high value litigation matters

Manage land claims and Bought-In properties
1. Drive the recovery of money on properties subject to land claims.
2. Track all claims to ensure that maximum recovery takes place
3. Engagement with land claims department and Department of Rural Development and Land Reform (DRDLR) to ensure speedy resolution of land claim related cases
4. Negotiate and finalise sale agreements for land claim properties
5. Manage and maintain Bought in properties (security, fire breaks, insurance etc.)
6. Manages effective disposal of Bought in Properties by the Bank (website with all properties)

Departmental and People Management
Performance Management
1. Analyse the business plan to determine the applicable deliverables and targets
2. Conduct performance planning session and Track and monitor performance in accordance with performance contracts
3. Conduct performance reviews in accordance with policies and procedures and take corrective actions where necessary
4. Provide coaching and feedback to employees on how to improve and sustain their performance

Capacity Planning
1. Determine the human resource requirements, in accordance with the expected deliverables and current capacity
2. Secure the human capital requirements to ensure that deliverables will be met in accordance with the expected targets
3. Set and achieve employment equity targets.
4. Minimise staff turnover

Financial Management
1. Develop and manage budget
2. Manage expenditure and ensure no fruitless expenditure
3. Adhere to financial guidelines and thus ensure proper control over expenditure
REQUIREMENTS FOR THIS JOB
PREFERRED MINIMUM EDUCATION AND EXPERIENCE
1. LLB degree or equivalent
2. Admission as on attorneys is a requirement
3. 8years experience in legal recoveries / debt collection environment, preferably in a bank at the senior management level
4. 8 years experience in restructuring of distressed accounts
