JOB PURPOSE Handles all legal activities of the bank. Provides an effective legal advice in the preparation of legal opinions, supplement the lending, banking and restructuring capability of the credit department and to provide more legal resource in other areas where the department is engaged. KEY RESPONSIBILITIES/TASKS 1. Preparation of offer letters, security documents and any other legal documents for the credit department and scrutiny of executed documents by customers to verify whether in order. 2. Registration of Bank’s charge at BRELA/Land office of various securities depending on the nature of the facility and documentation involved. 3. Follow up with all the empanelled legal firms and giving regular updates to the management on the status of all pending assigned work. This included matters of I&M Bank (T) Limited and I&M Bank Limited, Kenya, also where joint finance was involved. 4. Follow up of all pending court cases with relevant law firms. In the course, suggesting future course of action and giving regular updates to the management. 5. Sending legal notices to chronic defaulters as may be recommended by the Credit Department. 6. Giving instructions to empanelled advocates for issuance of formal Demand notices to defaulters who have not responded positively to the legal notices earlier served. 7. Regular review of security documents and facility letters to ensure all required securities are in place and Banks interest is protected. 8. Drafting/vetting of all the agreements/documents for contracts entered between bank and other vendors/service providers 9. Provide legal opinion/guidance where ever required by Bank including departments other than credit. 10. Regular review of security documents and facility letters to ensure all required securities are in place and Banks interest is protected. 11. Follow up and recovery of loans in arrears and expired overdraft. 12. Monitor the status of insurance policies of the borrowers and follow up with clients whose insurance policies are not in place or which have expired. 13. Work closely with rest of the team in the credit department to gain knowledge on other areas of the department. 14. Any other duties as assigned by the supervisor
Risk Management: 1. Conduct review of the security documents to ensure that the Bank’s interest is well protected and provide advice on risks that may arise 2. Ensure effective adoption and utilization of risk management tools 3. Drive remediation of risk management exceptions identified during audit or risk reviews 4. Promote risk management culture
